1) Agreement to Terms
These Terms & Conditions (“Terms”) are a legally binding agreement between you (“you”) and 247store (“Company,” “we,” “us,” or “our”), governing your use of 247store.us and related media, as well as your access to and use of any unattended / self-service physical store locations operated by us (collectively, the “Services”).
By accessing the Site or any 247store location (including via door codes), you agree to these Terms. If you do not agree, do not use the Services.
We may update these Terms at any time. The “Last updated” date will change and the revised Terms take effect upon posting. Your continued use constitutes acceptance.
Minors must have parental/guardian permission and supervision. Additional rules may apply to specific promotions, features, or locations.
2) Eligibility & Accounts
You represent that: (a) you have legal capacity to agree to these Terms; (b) you will comply with all laws; (c) you will not access the Services via automated or non-human means; (d) information you provide is accurate and current. We may suspend or terminate access for violations or false information.
3) Access Codes, Entry & In-Store Conduct (Self-Service Rules)
3.1 Door Codes & Identity Verification. Access codes sent by SMS are personal to you, time-limited, and may be rate-limited. Do not share your code. You consent to our logging of phone number, time, IP/device, and entry/exit events for security and loss-prevention. Misuse may result in fees and permanent bans.
3.2 Accompanied Entry. Do not allow strangers to tailgate. Each person should use their own code. You are responsible for the conduct of any guest you intentionally admit.
3.3 Video/Audio Monitoring. Premises may be protected by 24/7 video (and where posted, audio) recording for safety, operations, and loss-prevention. By entering, you consent to being recorded.
3.4 Merchandise Handling. Handle items with care. Do not tamper with fixtures, refrigerators, or safety devices. Follow on-screen or posted checkout instructions precisely.
3.5 Cleanliness & Damage. You agree to keep the space tidy and dispose of waste properly. Excessive mess, vandalism, or damage may incur a reasonable cleaning/repair fee and account termination.
3.6 Prohibited Conduct. No theft, fraud, harassment, threats, violence, weapons, alcohol or controlled substances (unless explicitly permitted by law and store policy), smoking/vaping, or loitering. Pets only as permitted by law (e.g., service animals).
3.7 Health & Safety. Do not consume products you are allergic to. Check labels and dates before purchase. If you notice safety issues (e.g., spills, broken glass), notify us via posted contact channels and avoid the hazard.
4) Purchases, Pricing, Refunds
4.1 Pricing & Taxes. Prices shown at checkout apply at the time of purchase. Taxes/fees may be added as required by law.
4.2 Payment Authorization. By completing checkout (including kiosk/app/website), you authorize us to charge your selected payment method for cart subtotal, taxes, deposits, and applicable fees. If you remove items after scan, you must void them per on-screen instructions.
4.3 Chargebacks & Investigations. You agree not to initiate fraudulent chargebacks. We may use entry logs, checkout data, and video records to contest disputes and may share information with law enforcement where permitted.
4.4 Perishables & Temperature-Sensitive Goods. All sales are final for perishables unless required by law or the product is verified defective at the time of sale. For quality concerns, contact us within a reasonable window with evidence (photos, jar/batch label).
4.5 Returns/Exchanges. Except as required by law or our posted policy, no returns or exchanges. If we issue a goodwill refund, it is at our sole discretion and does not waive these Terms.
5) Membership, Promotions, and SMS Terms
5.1 Membership. Certain benefits require an account. We may modify or terminate membership features at any time.
5.2 Promotions. Coupons and promotions are subject to posted rules and may be limited, modified, or withdrawn.
5.3 SMS Consent. By requesting access codes, alerts, or marketing via phone number, you consent to receive transactional SMS (e.g., door codes, security notices) and, if you opt in, marketing SMS. Message/data rates may apply. Reply STOP to opt out of marketing messages; you may still receive critical transactional SMS (e.g., one-time door codes) as permitted.
6) Intellectual Property
The Site, designs, software, text, images, video, audio, trademarks, and other content (“Content”) are owned or licensed by us and protected by law. You are granted a limited, revocable, non-transferable license for personal, non-commercial use. No other rights are granted. Do not copy, distribute, or exploit Content without written permission.
7) User Content & Feedback
If you submit reviews, photos, or feedback (“Contributions”), you represent you have the necessary rights and that your Contributions are lawful and non-infringing. You retain ownership of your Contributions, but you grant us a worldwide, royalty-free license to use, host, display, and adapt them for operating and improving the Services. Feedback may be used by us for any purpose without compensation.
8) Third-Party Links & Services
We are not responsible for third-party websites, apps, payment processors, or content. Your dealings with third parties are solely between you and them.
9) Privacy & Security
Use of the Services is subject to our Privacy Policy (posted on the Site), which explains what data we collect (including entry logs and video), how we use it, and your choices. We employ reasonable safeguards but cannot guarantee absolute security.
10) Availability, Maintenance & Modifications
The Services (site, app, kiosks, door systems, refrigeration, payments) may be unavailable due to maintenance, outages, or events beyond our control. We may change, suspend, or discontinue features without notice and are not liable for resulting losses.
11) Errors & Corrections
Information (including product descriptions, pricing, and availability) may contain errors or omissions. We may correct or update at any time.
12) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. YOU ASSUME ALL RISK FOR YOUR USE OF UNATTENDED PREMISES AND PRODUCTS (INCLUDING ALLERGENS AND STORAGE AFTER PURCHASE).
13) Limitations of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE OR OUR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, DATA LOSS, PERSONAL INJURY RESULTING FROM YOUR FAILURE TO FOLLOW POSTED SAFETY RULES, OR PROPERTY DAMAGE). OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE TRANSACTION AT ISSUE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; THOSE LIMITATIONS MAY NOT APPLY TO YOU.
14) Indemnification
You agree to indemnify, defend, and hold harmless 247store and its affiliates from claims, losses, liabilities, costs, and fees (including reasonable attorneys’ fees) arising out of (a) your misuse of access codes or Services; (b) your violations of these Terms; (c) property damage, theft, or injury caused by you; or (d) your infringement of third-party rights.
15) Termination & Bans
We may suspend or terminate your account or block your access (including by phone number or IP) at any time for any reason, including suspected theft, fraud, chargeback abuse, harassment, or safety violations. After termination, you may not register under a new identity without our written consent.
16) Governing Law; Dispute Resolution
16.1 Governing Law & Venue. These Terms are governed by the laws of the State of California, without regard to conflicts principles.
16.2 Arbitration & Class-Action Waiver. Except for small claims or injunctive relief to protect security/intellectual property, any dispute arising from or relating to the Services or these Terms will be resolved by binding arbitration administered by a recognized provider. You and we waive any right to a jury trial and to participate in a class or representative action.
16.3 Time to File. Any claim must be filed within one (1) year after it arose or be forever barred, to the extent permitted by law.
17) Store-Specific Rules & Fees (Notice)
We may post store-specific notices at each location (e.g., deposit jars, equipment use rules, after-hours contact, spill protocol). Those notices form part of these Terms. We may assess reasonable cleaning, repair, restocking, or non-returnable container fees where applicable and disclosed on-site or at checkout.
18) Miscellaneous
These Terms (plus posted policies) are the entire agreement between you and us. If any provision is unenforceable, the remainder remains in effect. Our failure to enforce is not a waiver. You agree these Terms will not be construed against the drafter. Electronic acceptance has full legal effect. We may assign these Terms; you may not without our consent.
